ParkEats respects the intellectual property rights of others and expects its users to do the same. ParkEats lets users contribute photos, reviews, and listings. We do not review that content before it is posted, and we respond to valid notices of claimed copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512.

If you believe material available on ParkEats infringes a copyright you own or are authorized to act on behalf of, you may send us a notice using the process below. We will remove or disable access to material that is the subject of a valid notice.

↓ Filing a Takedown Notice

To be effective, your written notice must include substantially all of the following:

1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
2. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered by a single notice.
3. Identification of the material you claim is infringing, with enough detail for us to locate it — a direct link or the exact screen, listing name, and photo is best.
4. Your contact information: name, mailing address, telephone number, and email address.
5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will act expeditiously on notices that meet these requirements. We will make a good faith effort to notify the user who posted the material and provide them with a copy of your notice.

↑ Filing a Counter-Notice

If your material was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notice to the agent listed above. It must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
4. Your name, mailing address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal district court for the district where you live (or, if you are outside the United States, the United States District Court for the District of Utah, where ParkEats may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notice, we will forward it to the party who filed the original notice. Unless that party notifies us within ten business days that they have filed an action seeking a court order to restrain the activity, we may restore the removed material in ten to fourteen business days.

∅ Repeat Infringers

ParkEats has adopted and will reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

We record valid notices against each account. An account that accumulates repeated valid notices of infringement will be terminated, and we may terminate an account at any time for a single egregious act of infringement. We may also refuse service to anyone whose account has been terminated under this policy.
